4. User Obligations

As a user of our services, you agree to:

4.1 Eligibility and Registration

• Provide accurate and complete information during registration
• Maintain the confidentiality of your account credentials
• Be at least 18 years of age or have parental consent
• Notify us immediately of any unauthorised use of your account

4.2 Acceptable Use

• Use our services only for lawful purposes
• Respect the rights of other participants and instructors
• Not share course materials without explicit permission
• Not engage in disruptive or inappropriate behaviour during training sessions
• Comply with all applicable laws and regulations

4.3 Prohibited Activities

5. Intellectual Property

• Our trademarks, logos, and brand elements may not be used without written permission
• We reserve the right to modify or update course content at any time

5.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable licence to access and use course materials solely for your personal educational purposes. This licence terminates upon completion of your course or termination of your access to our services.

5.3 Student Work

You retain ownership of any original work you create during our courses. However, you grant us a licence to use such work for educational and promotional purposes, including showcasing student achievements.

6. Payment Terms

Payment for our services is subject to the following terms:

6.1 Course Fees

• All prices are listed in Euros (EUR) and include applicable VAT
• Payment is due in full before course commencement unless alternative arrangements are made
• We accept major credit cards, bank transfers, and other approved payment methods
• Corporate clients may be offered invoice payment terms upon approval

6.2 Refund Policy

• Cancellations made more than 14 days before course start date: Full refund minus administrative fee
• Cancellations made 7-14 days before start date: 50% refund
• Cancellations made less than 7 days before start date: No refund
• No refunds after course commencement except in exceptional circumstances

7. Course Policies

7.1 Attendance and Participation

• Regular attendance is required for successful course completion
• Minimum 80% attendance required for certification
• Active participation in discussions and exercises is expected
• Make-up sessions may be available for excused absences

7.2 Certification

• Certificates are awarded upon successful completion of course requirements
• Assessment criteria will be clearly communicated at course commencement
• Certificates are issued in digital format unless otherwise specified
• Replacement certificates may be issued for a nominal fee

8. Limitation of Liability

To the maximum extent permitted by law, prismvecto's liability is limited as follows:

8.1 Service Availability

• We strive to provide uninterrupted service but do not guarantee 100% uptime
• We are not liable for temporary service interruptions or technical issues
• Course schedules may be subject to change due to unforeseen circumstances

8.2 Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.3 Limitation of Damages

In no event shall prismvecto be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of our services.

8.4 Maximum Liability

Our total liability for any claims arising out of or relating to these Terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Austria. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Austria.

9.1 Dispute Resolution

Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If direct negotiations fail, disputes may be submitted to mediation or arbitration as mutually agreed.

9.2 Consumer Rights

If you are a consumer under Austrian or EU law, you may have additional rights that cannot be limited by these Terms. These Terms do not affect any statutory rights you may have as a consumer.

10. Termination

Either party may terminate the relationship under the following circumstances:

10.1 Termination by You

• You may terminate your enrollment subject to our cancellation and refund policy
• You may request account deletion in accordance with our Privacy Policy
• Termination does not relieve you of payment obligations for services already received

10.2 Termination by Us

We may terminate or suspend your access to our services immediately if you:

• Violate these Terms or our policies
• Fail to make required payments
• Engage in conduct that is harmful to other users or our business
• Provide false or misleading information

10.3 Effect of Termination

Upon termination:

• Your access to course materials and services will cease
• Completed certifications remain valid
• Certain provisions of these Terms will survive termination

These Terms, together with our Privacy Policy and any additional course-specific terms, constitute the entire agreement between you and prismvecto regarding your use of our services and supersede all prior or contemporaneous communications and proposals.
